Terms of Service

Article 1 (Purpose)

The purpose of these Terms is to set forth the rights, obligations, and responsibilities of, and other necessary matters between, ReturnPixel Co., Ltd. (hereinafter the "Company") and its Members regarding the use of the game service and the incidental network, website, and other services (hereinafter the "Service") provided by the Company.

Article 2 (Definitions of Terms)

The definitions of the terms used in these Terms are as follows:
1. "Member" means a person who enters into a service agreement in accordance with these Terms and uses the Service provided by the Company.
2. "Temporary Member" means a Member who uses the Service without authentication or through guest login mode.
3. "Device" means a device on which content can be downloaded or installed and used, including mobile phones, smartphones, personal digital assistants (PDAs), tablets, and the like.
4. "Account Information" collectively refers to the Member's membership number and external account information, device information, nickname, profile picture, friend list, and other information the Member has provided to the Company, as well as game usage information (character information, items, level, etc.) and payment information for usage fees.
5. "Content" means all paid or free digital material produced by the Company in connection with the provision of the Service for use on a Device (games and network services, applications, game money, game items, etc.).
6. "Paid Payment" means a payment act made through a payment company recognized by the Company in order to purchase or use content, etc. within the Service.
7. "Open Market" means an e-commerce environment built so that game content can be installed and paid for on a Device.
8. "Payment Company" means a company that provides electronic payment methods usable in an open market, such as credit cards and mobile phone payments.
9. "Application" means all programs downloaded or installed and used through a Device in order to use the Service provided by the Company.
10. "Game Service" means, as one of the services provided by the Company, the game that the Member runs on a Device and its incidental services.
Except as defined in Paragraph 1 of this Article, the definitions of the terms used in these Terms shall be governed by the relevant statutes and service-specific policies; matters not provided for therein shall follow general commercial practice.

Article 3 (Provision of Company Information, etc.)

The Company shall display the following matters in a manner easily recognizable by Members, in accordance with the relevant statutes:

The trade name and the name of the representative, the address of the place of business, telephone number, and e-mail address
The Terms of Service and the Privacy Policy
The business registration number and the mail-order business report number

Article 4 (Effect, Application, and Amendment of the Terms)

These Terms take effect upon the Member's agreement to them. The Company shall post the contents of these Terms within the Game Service or on a linked screen so that Members can be aware of them. In this case, important content among these Terms — such as service suspension, withdrawal of subscription, refund, termination of contract, cancellation, and the Company's exemption from liability — shall be clearly indicated using bold text, color, symbols, etc., or processed in a manner easily recognizable by Members through a separate linked screen.
Where the Company amends the Terms, it shall specify the effective date, the amended content, the reason for the amendment, etc., and shall post the amendment within the Game Service or on a linked screen and notify Members at least 7 days before the effective date. However, where the amended content is unfavorable to Members or constitutes a material change, the Company shall give notice in the same manner as above at least 30 days before the effective date and shall notify Members by the method set forth in Article 26, Paragraph 1. In this case, the pre-amendment and post-amendment content shall be clearly compared and displayed so that Members can easily understand them.
Where the Company amends the Terms, it shall, after giving notice of the amended Terms, confirm whether Members consent to the application of the amended Terms. When giving the notice under Paragraph 2, the Company shall also announce or notify that a Member who does not express consent or refusal regarding the amended Terms may be deemed to have consented, and if a Member does not express refusal by the effective date of these Terms, the Member may be deemed to have consented to the amended Terms. If a Member does not consent to the amended Terms, the Company or the Member may terminate the service agreement.
The Company shall take measures so that Members can raise questions and receive answers from the Company regarding the contents of these Terms.
The Company may amend these Terms within the scope that does not violate relevant statutes such as the "Act on the Consumer Protection in Electronic Commerce, etc.," the "Act on the Regulation of Terms and Conditions," the "Game Industry Promotion Act," the "Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.," and the "Content Industry Promotion Act."

Article 5 (Conclusion and Application of the Service Agreement)

The service agreement is concluded when a person who wishes to become a Member (hereinafter the "Applicant") agrees to the contents of these Terms, then applies to use the Service, and the Company accepts the application.
The Company commences the Service from the time it accepts the Applicant's application. However, for some services, the Company may commence the Service from a designated date as the Company deems necessary, and the Company may refuse or suspend the provision of the Service in the following cases:
1. Where the Applicant falsely enters the details of the application or fails to meet the application requirements
2. Where the Service is used through abnormal or circumventing methods in a country where the Company does not provide the Service
3. Where the application is made for the purpose of engaging in acts prohibited by relevant statutes such as the "Game Industry Promotion Act"
4. Where the application is made for the purpose of undermining public peace and order or good morals
5. Where the Applicant intends to use the Game Service for improper purposes
6. Where the Applicant intends to use the Game Service for profit-making purposes
7. Where a minor (a person under 18 years of age, including a student enrolled in a high school under Article 2 of the "Elementary and Secondary Education Act") has not obtained the consent of their legal representative, or such consent cannot be confirmed
8. Where, for other reasons equivalent to the above, acceptance is deemed inappropriate
The Company may withhold acceptance until the relevant grounds are resolved in any of the following cases:
1. Where there is insufficient capacity in the Company's facilities, support for a particular Device is difficult, or there is a technical obstacle
2. Where an obstacle has occurred in the Service, or in the service usage fees or payment methods
3. Where it is recognized that there is a risk of the applicant engaging in inappropriate conduct as a "Member"
4. Where, for other reasons equivalent to the above, acceptance of the application is deemed difficult
The Company may differentiate the scope of the Service, usage time, service menus, etc. by classifying Members by type and grade in accordance with the Company's policy and relevant statutes. The Company may request additional information in order to adjust the scope of the Service or to provide certain services.

Article 6 (Operating Policy)

Matters necessary to apply the Terms and matters delegated by specifying a concrete scope in the Terms may be established as a Game Service operating policy (hereinafter the "Operating Policy").
The Company shall post the contents of the Operating Policy within the Game Service or on a linked screen so that Members can be aware of them.
When amending the Operating Policy, the procedure under Article 4, Paragraph 2 shall be followed. However, where the amended content of the Operating Policy falls under any of the following, it shall be announced in advance by the method under Paragraph 2:
1. Where matters delegated by specifying a concrete scope in the Terms are amended
2. Where matters unrelated to the rights and obligations of Members are amended
3. Where the Operating Policy is amended within a scope that is not fundamentally different from the content prescribed in the Terms and that Members can foresee

Article 7 (Protection and Use of Personal Information)

The Company shall endeavor to protect the personal information of Members in accordance with relevant statutes, and the protection and use of personal information shall be governed by the relevant statutes and the Company's Privacy Policy. However, the Company's Privacy Policy does not apply to linked services other than the services provided by the Company.
Depending on the nature of the Service, content introducing oneself — such as a nickname, character picture, and status information — that is unrelated to the Member's personal information may be disclosed.
Except where there is a request from a relevant state agency, etc. under relevant statutes, the Company shall not provide a Member's personal information to others without the Member's consent.
The Company shall not be liable for damage arising from the leakage of personal information due to reasons attributable to the Member.

Article 8 (Obligations of the Company)

The Company shall faithfully comply, in good faith, with the exercise of rights and the performance of obligations prescribed by the relevant statutes and these Terms.
The Company shall establish a security system to protect personal information (including credit information) so that Members can use the Service safely, and shall disclose and comply with the Privacy Policy.
Except as provided in these Terms and the Privacy Policy, the Company shall ensure that a Member's personal information is not disclosed or provided to a third party.
In order to provide continuous and stable service, if a facility malfunction occurs or data, etc. is lost or damaged during service improvement, the Company shall make its best efforts to repair or restore it without delay, unless there are unavoidable reasons such as a natural disaster, an emergency, or an obstacle or defect that is impossible to resolve with current technology.

Article 9 (Obligations of the Member)

A Member shall not engage in any of the following acts in connection with the use of the Service provided by the Company:
1. Using information that is not one's real name or another person's information, or entering false facts, when providing personal information to the Company for customer inquiries, recovery of and refund requests for paid content, event winnings, etc.
2. Stealing or improperly using another Member's account information, or purchasing paid content by unauthorized use of another person's credit card, wired/wireless telephone, bank account, etc.
3. Trading or gifting an ID, character, item, game money, etc. through abnormal methods, or acquiring and using such items
4. Copying, distributing, or promoting information obtained by using the Company's Service and provided Application without the Company's prior consent, or using it commercially, or using the Service by exploiting known or unknown bugs
5. Using the Company's Service and provided Application to enable oneself or others to obtain financial gain
6. Infringing the Company's intellectual property rights, a third party's intellectual property rights, portrait rights, or other rights, or collecting, storing, distributing, or posting other Members' personal information
7. Deceiving a third party to obtain benefits, or using the Service provided by the Company in an unwholesome manner so as to cause harm to a third party
8. Damaging the reputation of the Company or other third parties, or interfering with their business
9. Exchanging or posting obscene or vulgar information, linking to obscene sites, or posting unauthorized advertisements or promotional materials
10. Transmitting, delivering, or distributing to another party words, sounds, text, images, or videos that cause shame, disgust, or fear
11. Inducing or participating in speculative acts such as gambling with property at stake
12. Transmitting, posting, distributing, or using information (computer programs) whose transmission or posting is prohibited by relevant statutes, or materials containing software viruses, other computer code, files, or programs designed to interfere with or destroy the normal operation of computer software, hardware, or telecommunications equipment
13. Without being granted special rights by the Company, altering the Application or adding or inserting other programs into the Application; hacking or reverse-engineering the server; leaking or altering source code or application data; building a separate server; or arbitrarily altering or misappropriating part of the website to impersonate the Company
14. Posting content or sending mail while pretending to be or impersonating an employee or operator of the Company, or by stealing another person's name
15. Using the Service for the purpose of profit-making, business, advertising, political activity, illegal election campaigning, etc. without the Company's consent
16. Intentionally interfering with the operation of the Service, or transmitting information, etc. that may interfere with the stable operation of the Service
17. Spreading false content as if it were true, thereby causing confusion to other Members or otherwise interfering with the Company's normal operation of the Service
18. Interfering with other Members' smooth use of the Service through profanity/defamation, spamming chat/bulletin boards, obstructing game progress, etc.
19. Obtaining unfair benefits by circumventing the limitations of the game system design through abnormal methods (abusing)
20. Obtaining unfair benefits by abusing the payment and refund policies provided by the Company, the open market operator, or the platform operator
21. Infringing the human rights of the Company's counselors and thereby interfering with their work
22. Other acts that violate public order and good morals, or that are illegal, unfair, or in violation of relevant statutes
The responsibility for managing the Member's account and Device rests with the Member, and the Member shall not allow others to use them. The Company shall not be liable for damage arising from poor management of the Device or from allowing others to use it.
Members shall set and manage a payment password function so that improper payments are not made in each open market. The Company shall not be liable for damage arising from the Member's negligence.
The Company may prescribe the specific details of the following acts, and Members shall comply with them:
1. The Member's account name, character name, guild name, and other names used within the game
2. Chat content and methods
3. Bulletin board use and service usage methods
4. External mobile platform partner service policies, such as affiliate service policies
5. Restrictions on game play methods
6. Other matters that the Company deems necessary for service operation, within the scope that does not infringe the essential rights of Members regarding the use of the Service

Article 10 (Provision of the Service)

In accordance with the provisions of Article 5, the Company shall enable a Member who has completed the service agreement to use the Service immediately. However, for some services, the Company may commence the Service from a designated date as the Company deems necessary.
When providing the Game Service to Members, the Company may provide other additional services together with the services set forth in these Terms.
The Company may classify Members by grade and differentiate their usage by subdividing usage time, number of uses, the scope of provided services, etc.

Article 11 (Use of the Service)

The Game Service is provided for the hours set according to the Company's business policy. The Company shall announce the Game Service provision hours by an appropriate method on the initial screen of the game Application or in the Game Service notices. In the absence of separate indication or notice, 24-hour provision is the default.
Notwithstanding Paragraph 1, the Company may temporarily suspend all or part of the Service in the following cases. In such cases, the Company shall announce the reason and period of the suspension in advance on the initial screen of the game Application or in the Game Service notices, etc. However, where there are unavoidable circumstances that make advance notice impossible, notice may be given afterward.
1. Where necessary for system operation, such as regular system inspection, expansion or replacement of servers, or network instability
2. Where normal service provision is impossible due to a power outage, a failure of service facilities, a surge in service usage, or facility maintenance or inspection by a common telecommunications carrier
3. Where a situation beyond the Company's control occurs, such as war, an incident, a natural disaster, or a national emergency equivalent thereto
4. Where the relevant statutes or government and Company policies prohibit service provision by means such as restrictions on specific times or numbers of uses
The Service is provided using a dedicated Application for the Device or a network. Members can download and install the Application, or use the Service free of charge or for a fee via a network.
Paid content may be used only upon payment of the fee specified for the relevant service. When downloading the Application or using the Service via a network, a separate fee set by the subscribed mobile carrier may be incurred.
Downloaded and installed Applications, or services used via a network, are provided to suit the characteristics of the Device or mobile carrier. In the case of a change of Device, change of number, or international roaming, all or part of the content may be unusable, and the Company shall not be liable in such cases.
For downloaded and installed Applications, or services used via a network, background tasks may run. In such cases, additional fees may be incurred to suit the characteristics of the Device or mobile carrier, and the Company shall not be liable in this regard.
In order to smoothly provide the Service to Members who have applied to use it, the Company may install or change (update) programs necessary for service use — such as individual game clients, security programs, and payment modules — without the additional consent of the Member. However, when installing a program unrelated to the use of the Game Service, such as an advertising program, the Company shall notify the Member and obtain consent before installation.
The Company may change the functions of existing items, etc., or change them to be unusable, in accordance with changes in game content, balance maintenance, item policy, etc. In this case, where a paid item whose usage period has not elapsed becomes unusable, the Company shall compensate with an equivalent paid item, points, etc. corresponding to the remaining usage period of the paid item purchased for a fee.

Article 12 (Change and Suspension of the Service)

The Company may change the Service according to operational or technical needs in order to provide a smooth Game Service, and shall announce the relevant content within the Game Service before the change. However, where a change is unavoidably necessary — such as fixing bugs or errors, or an emergency update — or where the change does not constitute a material change, notice may be given afterward.
Where it is difficult to continue the Game Service due to significant business reasons — such as discontinuation of business due to transfer, division, or merger; expiration of the game provision contract; or significant deterioration in the profitability of the Game Service — the Company may discontinue the entire Service. In this case, the Company shall announce the discontinuation date, the reason for discontinuation, the compensation conditions, etc. on the initial screen of the game Application or on a linked screen at least 30 days before the discontinuation date, and shall notify Members by the method under Article 26, Paragraph 1.
Where the Company terminates the Game Service under Paragraph 2, Members may not claim damages for free services and for paid services / continuous paid usage agreements / fixed-term paid content that have no remaining usage period. For paid game items with no usage period limit, the service termination date shall be deemed the usage period of the relevant paid game item.
The Company shall compensate for suspensions or malfunctions of paid services provided by the Company as follows, and Members may not claim separate damages against the Company:
1. Where, due to reasons attributable to the Company, the Service is continuously suspended or malfunctions for 4 hours or more per day (cumulative) without prior notice, the Company shall, only for fixed-term paid service accounts, extend the usage time free of charge by an amount equivalent to three times the service suspension/malfunction time.
2. Where the Company gives prior notice of a service suspension/malfunction due to reasons such as server inspection, but the service suspension/malfunction time exceeds 10 hours, the Company shall, only for fixed-term paid service accounts such as flat-rate services, extend the usage time free of charge by the amount of the exceeded time.
3. For paid services where an extension of usage time is not possible, the Company shall, at its option, compensate for the service suspension/malfunction with an equivalent paid service, etc.

Article 13 (Collection of Information)

The Company may store and retain chat content exchanged between Members, and this information shall be held solely by the Company. The Company may view this information only for the purpose of resolving disputes between Members, handling complaints, or maintaining game order; a third party may view it only where authorized by statute.
Where the Company or a third party views chat information under Paragraph 1, the Company shall notify the relevant Member of the reason and scope of viewing in advance. However, where it is necessary to view this information in connection with the investigation, handling, or confirmation of prohibited acts under Article 10, Paragraph 1 [sic], or with remedying damage caused by such acts, notice may be given afterward.
The Company may collect and utilize the Member's Device information (settings, specifications, operating system, version, etc.), excluding the Member's personal information, for the smooth and stable operation of the Service and the improvement of service quality.
The Company may request additional information from Members for purposes such as service improvement and introducing services to Members. Members may accept or refuse this request, and when making this request, the Company shall also notify Members that they may refuse the request.

Article 14 (Provision of Advertisements)

In connection with the operation of the Company's Service, advertisements may be posted within the Game Service. In addition, only to Members who have consented to receipt, advertising information may be transmitted by methods such as e-mail, text service (LMS/SMS), and push notifications. In this case, Members may refuse receipt at any time, and the Company shall not send advertising information upon a Member's refusal of receipt.
Advertisements or services provided by others may be linked through banners or links, etc. within the services provided by the Company.
Where a Member is connected to an advertisement or service provided by others under Paragraph 2, the service provided in that area is not the Company's service area, so the Company does not guarantee its reliability, stability, etc., and the Company shall not be liable for any damage to the Member arising therefrom. However, this shall not apply where the Company, through intent or gross negligence, facilitated the occurrence of the damage or failed to take measures to prevent the damage.

Article 15 (Attribution of Copyright, etc.)

Copyright and other intellectual property rights to the content within the Game Service produced by the Company belong to the Company. In addition, in connection with the Game Service, the Company grants Members only the right to use games, characters, game items, game money, etc. in accordance with the usage conditions set by the Company, and Members may not share these with a third party or dispose of them by transfer, sale, provision as collateral, etc. Furthermore, when the Game Service usage agreement under these Terms is terminated, the Member shall immediately delete the content, including the game client.
Members shall not, without the prior consent of the Company or the provider, use for profit-making purposes — or allow others to use — information whose intellectual property rights belong to the Company or the provider, among the information obtained by using the Game Service provided by the Company, by means such as reproduction or transmission (including editing, publication, performance, distribution, broadcasting, creation of derivative works, etc.; the same shall apply hereinafter).
Members permit the Company to use, under the following methods and conditions, all communications including chat text, images, sounds, and all materials and information (hereinafter "User Content") that appear in the game or that the Member or other users upload or transmit through the game Application or Game Service in connection with the Game Service:
1. Using, editing, changing the format of, and otherwise modifying such User Content (usable in any form including publication, reproduction, performance, transmission, distribution, broadcasting, and creation of derivative works, with no restriction on usage period and region)
2. Not selling, renting, or transferring User Content for the purpose of transactions without the prior consent of the user who created the User Content
With respect to a Member's User Content that does not appear in the game and is not integrated with the Game Service (e.g., posts on general bulletin boards), the Company shall not use it without the Member's explicit consent, and the Member may delete such User Content at any time.
Where the Company deems that a post within the Service posted or registered by a Member falls under a prohibited act under Article 10, Paragraph 1 [sic], the Company may delete or move it, or refuse its registration, without prior notice.
A Member whose legal interests are infringed by information posted on a bulletin board, etc. operated by the Company may request the Company to delete the relevant information or to post rebuttal content. In this case, the Company shall promptly take necessary measures and notify the applicant thereof.
Where the Company receives an objection such as a claim for damages from another person on the grounds that a Member's post has infringed that person's rights, the Member who created the post shall actively cooperate to exempt the Company from liability, and if the Company is not exempted, the Member shall bear responsibility for the problems arising therefrom.
This Article is valid while the Company operates the Game Service, and continues to apply even after a Member withdraws.

Article 16 (Purchase, Usage Period, and Use of Paid Content)

Paid content purchased by a Member within the Game Service may be used only on the Device on which the relevant Application was downloaded or installed. However, in the case of a Temporary Member, it may be used only on the Device on which the Application was downloaded or installed.
The usage period of paid content purchased by a Member follows the period specified at the time of purchase. However, where a service discontinuation is carried out under Article 12, Paragraph 2, the usage period of paid content with no fixed period shall be until the service discontinuation date announced at the time of the discontinuation notice.
Content purchased by a Member is classified into paid/free attributes according to the acquisition method, and when part of the held content — including such content — is used, the paid attribute is deducted first, and thereafter the free attribute is deducted. When only paid attributes are held, the order of deduction follows the first-in, first-out method (deduction in the order acquired first).
Except by methods separately prescribed and notified by the Company, a Member may use purchased paid content only in the Member's own account, and may not transfer, rent, or sell it to a third party.

Article 17 (Restrictions on Service Use for Members)

A Member shall not engage in acts that violate the Member's obligations under Article 9, and if a Member does so, the Company may take usage restriction measures, including restricting the Member's service use, deleting related information (text, photos, videos, etc.), and other measures, according to the following categories. The specific grounds and procedures for usage restriction measures shall be prescribed in the operating policy of each individual game in accordance with Article 9, Paragraph 1.
1. Restriction of authority: restricting certain authorities such as chat for a certain period
2. Restriction of character use: restricting the use of the Member's character for a certain period or permanently
3. Restriction of account use: restricting the use of the Member's account for a certain period or permanently
4. Restriction of Member use: restricting the Member's use of the Game Service for a certain period or permanently
Where the restriction under Paragraph 1 is justified, the Company shall not compensate for the damage the Member suffers due to the usage restriction.
The Company may suspend the service use of the relevant account until the investigation of the following grounds is completed:
1. Where a legitimate report is received that the account has been hacked or stolen
2. Where the account is suspected of being a user of an illegal program or a violator of law such as a workshop (gold-farming operation)
3. Where, for other reasons equivalent to the above, provisional measures on service use are necessary
After the investigation under Paragraph 3 is completed, in the case of a paid Game Service, the Company shall extend the Member's usage time by the suspended time or compensate with an equivalent paid service, cash, etc. However, this shall not apply where the Member falls under any of the grounds in Paragraph 3.

Article 18 (Grounds and Procedures for Usage Restriction Measures)

The Company shall prescribe, in the operating policy, the specific grounds and procedures for usage restriction measures under Article 17, Paragraph 1, taking into account the content, degree, frequency, and results, etc. of the prohibited acts under Article 9, Paragraph 1.
Where the Company takes a usage restriction measure prescribed in Article 18, Paragraph 1 [sic], it shall notify the Member in advance of the following matters. However, where urgent action is necessary, notice may be given afterward:
1. The grounds for the usage restriction measure
2. The type and period of the usage restriction measure
3. The method for filing an objection to the usage restriction measure

Article 19 (Procedure for Objections to Usage Restriction Measures)

A Member who wishes to contest the Company's usage restriction measure shall submit to the Company, within 15 days from the date of receiving notice of the measure, an objection stating the reasons for the objection in writing, by e-mail, or by a method equivalent thereto.
The Company shall respond to the reasons for the objection in writing, by e-mail, or by a method equivalent thereto within 15 days from the date of receiving the objection under Paragraph 1. However, where it is difficult to respond within this period, the Company shall notify the reason and the processing schedule.
Where the reasons for the objection are valid, the Company shall take measures accordingly.

Article 20 (Payment)

The imposition and payment of the purchase price for content shall, in principle, follow the policies or methods set by the mobile carrier, open market operator, etc. In addition, the limit for each payment method may be granted or adjusted according to the policy set by the Company or the open market operator, or the government's policy.
Where the purchase price of content is paid in foreign currency, the actual billed amount may differ from the price displayed in the service's store, etc., due to exchange rates, fees, etc.

Article 21 (Withdrawal of Subscription, etc.)

A Member who has entered into a contract with the Company for the purchase of paid content may withdraw the subscription within 7 days from the later of the purchase contract date and the content availability date, without bearing any separate fees, penalties, etc.
In the following cases, a Member may not withdraw a subscription under Paragraph 1 against the Company's will. However, in the case of a purchase contract consisting of divisible content, this shall not apply to the remaining part of the divisible content that does not fall under any of the following:
1. Paid content that is used or applied immediately upon purchase
2. Where additional benefits are provided, content whose additional benefits have been used
3. Where an act of opening can be regarded as use, or where there has been an act of opening content whose utility is determined upon opening
For content for which withdrawal of subscription is not possible under the provisions of each subparagraph of Paragraph 2, the Company shall clearly indicate that fact in a place easily recognizable by Members, and shall take measures — such as providing a trial-use product of the relevant content (allowing temporary use, providing a trial version, etc.) or, where such provision is difficult, providing information about the content — so that the Member's exercise of the right to withdraw a subscription is not obstructed. If the Company fails to take such measures, the Member may withdraw the subscription notwithstanding the grounds for restricting withdrawal in each subparagraph of Paragraph 2.
Notwithstanding Paragraphs 1 and 2, where the content of the paid content purchased by a Member differs from the content of the display/advertisement, or is performed differently from the content of the purchase contract, the Member may withdraw the subscription within 3 months from the date the relevant content became available, or within 30 days from the date the Member knew or could have known of that fact.
When a Member withdraws a subscription, the Company shall confirm the purchase history through the open market operator. In addition, the Company may contact the Member through the information provided by the Member to confirm the Member's legitimate reason for withdrawal, and may request additional documentary evidence.
Where a subscription is withdrawn under the provisions of Paragraphs 1 through 4, a Member who has entered into a contract with the Company for the purchase of paid content may withdraw the subscription within 7 days from the later of the purchase contract date and the content availability date, without bearing any separate fees, penalties, etc. [as in original]
Where a minor concludes a content purchase contract on a Device, the Company shall notify that, absent the consent of the legal representative, the minor or the legal representative may cancel the contract; and where a minor concludes a purchase contract without the consent of the legal representative, the minor or the legal representative may cancel the contract with the Company. However, cancellation is not possible where the minor purchased the content with property that the legal representative permitted to be disposed of within a specified scope, or where the minor deceived the other party into believing the minor was of legal age or that the legal representative's consent existed.
Whether a party to a content purchase contract is a minor shall be determined based on the Device on which payment was made, the payment executor information, the name of the payment method holder, etc. In addition, the Company may request the submission of documents that can prove the minor and the legal representative in order to confirm whether the cancellation is legitimate.

Article 22 (Refund of Overpayments)

Where an overpayment occurs, the Company shall refund the overpayment to the Member. However, where the overpayment occurred due to the Member's fault, without the Company's intent or negligence, the actual cost of the refund shall be borne by the Member within a reasonable scope.
Payment through the Application follows the payment method provided by the open market operator, and where an overpayment occurs during the payment process, a refund shall be requested from the Company or the open market operator.
Communication charges (call charges, data charges, etc.) incurred by downloading the Application or using network services may be excluded from the scope of refunds.
Refunds shall be processed in accordance with the refund policy of each open market operator or the Company, depending on the type of operating system of the Device on which the Service is used.
The Company may contact the Member through the information received from the Member in order to process the refund of the overpayment, and may request the provision of necessary information. The Company shall make the refund within 3 business days from the date it receives the information necessary for the refund from the Member.

Article 23 (Termination of Contract, etc.)

A Member may terminate the usage agreement at any time through member withdrawal if the Member no longer wishes to use the Game Service. Due to member withdrawal, all game usage information held by the Member within the Game Service shall be deleted and become unrecoverable.
Where there is a significant reason that makes it impossible to maintain this contract — such as a Member engaging in acts prohibited by these Terms and the operating policy and service policy thereunder — the Company may, after giving reasonable prior notice and setting a period, suspend service use or terminate the usage agreement.
Refunds and damages under Paragraphs 1 and 2 shall be processed in accordance with the "Content User Protection Guidelines."
In order to protect the personal information of a Member who has not used the Company's service for one consecutive year from the most recent service usage date (hereinafter a "Dormant Account"), the Company may terminate the usage agreement and take measures such as destroying the Member's personal information. In this case, the Company shall notify the Member, at least 30 days before the date of the measure, of the fact that measures such as contract termination and personal information destruction will be taken, and of the personal information to be destroyed.

Article 24 (Damages)

Where the Company or a Member causes damage to the other party in violation of these Terms, it shall be liable to compensate for such damage. However, this shall not apply where there is no intent or negligence. In particular, where the Company receives a claim for damages, a lawsuit, or various other objections from a third party other than the relevant Member due to an illegal act or a violation of these Terms committed by the Member in using the Service, the relevant Member shall exempt the Company from liability at the Member's own responsibility and expense, and if the Company is not exempted, the relevant Member shall be liable to compensate for all damage incurred by the Company as a result.
Where the Company enters into a partnership agreement with an individual service provider and provides an individual service to a Member, and the Member, after agreeing to the terms of use of that individual service, suffers damage due to the intent or negligence of the individual service provider, the individual service provider shall be liable for that damage.

Article 25 (Exemption of the Company)

The Company shall not be liable for the provision of the Service where it cannot provide the Service due to a natural disaster or force majeure equivalent thereto.
The Company shall not be liable for damage arising from maintenance, replacement, regular inspection, construction, or other similar reasons regarding service facilities. However, this shall not apply in the case of the Company's intent or negligence.
The Company shall not be liable for obstacles to service use caused by the Member's intent or negligence. However, this shall not apply where the Member has unavoidable or justifiable reasons.
The Company shall not be liable for the reliability, accuracy, etc. of information or materials posted by Members in connection with the Service, unless there is intent or gross negligence on the part of the Company.
The Company has no obligation to intervene in transactions or disputes arising between a Member and other Members or third parties through the medium of the Service, and shall not be liable for any damage arising therefrom.
The Company shall not be liable for damage incurred by a Member in connection with the use of services provided free of charge. However, this shall not apply in the case of the Company's intent or gross negligence.
The Company shall not be liable for a Member's failure to obtain, or loss of, expected benefits from using the Service.
The Company shall not be liable for the loss of a Member's in-game experience points, grade, items, game money, etc. However, this shall not apply in the case of the Company's intent or negligence.
The Company shall not be liable for third-party payments arising from failure to manage the Member's Device password, the password provided by the open market operator, etc. However, this shall not apply in the case of the Company's intent or negligence.
Where a Member cannot use all or part of the functions of content due to a change of Device, change of Device number, change of operating system (OS) version, international roaming, change of carrier, etc., the Company shall not be liable therefor. However, this shall not apply in the case of the Company's intent or negligence.
Where a Member deletes content or account information provided by the Company, the Company shall not be liable therefor. However, this shall not apply in the case of the Company's intent or negligence.
The Company shall not be liable for damage arising from a Temporary Member's use of the Service. However, this shall not apply in the case of the Company's intent or negligence.

Article 26 (Notice to Members)

Where the Company gives notice to a Member, it may do so by the Member's e-mail address, electronic memo, in-Game Service message, text message (LMS/SMS), etc.
Where the Company gives notice to all Members, it may substitute for the notice under Paragraph 1 by posting within the Game Service for 7 days or more or by presenting a pop-up screen, etc.

Article 27 (Jurisdiction and Governing Law)

Disputes arising between the Company and a user in connection with the use of the Service shall be amicably resolved by agreement between the two parties.
If a dispute under Paragraph 1 is not amicably resolved, each party may apply for dispute mediation to the Content Dispute Mediation Committee in accordance with the Content Industry Promotion Act; and where the matter proceeds through litigation, the court determined by the procedure prescribed in the relevant statutes shall be the competent court. However, where the Member's address or place of residence is in a region outside the Republic of Korea at the time of filing, the Seoul Central District Court shall be the exclusive competent court.
The laws of the Republic of Korea shall apply as the governing law to litigation filed between the Company and a user.
If any item of these Terms is void or unenforceable according to a legal determination, only that content shall be deemed void. The remaining content of the Terms shall remain valid.

Article 28 (Handling of Member Grievances and Dispute Resolution)

In consideration of the Member's convenience, the Company shall provide guidance on methods for presenting Members' opinions or complaints within the Game Service or on a linked screen. The Company shall operate dedicated personnel to handle such Members' opinions or complaints.
Where an opinion or complaint raised by a Member is objectively recognized as justified, the Company shall promptly handle it within a reasonable period. However, where the handling takes a long time, the Company shall announce within the Game Service, or notify in accordance with Article 27, Paragraph 1 [sic], the reason for the long processing time and the processing schedule.
Where a dispute arises between the Company and a Member and a third-party dispute mediation body mediates it, the Company shall faithfully prove the matters it has taken against the Member, such as usage restrictions, and may comply with the mediation body's mediation.

Article 29 (Rules Outside the Terms)

For matters not prescribed in these Terms and for the interpretation of these Terms, the relevant statutes or commercial practice shall apply, including the "Act on the Consumer Protection in Electronic Commerce, etc.," the "Act on the Regulation of Terms and Conditions," the "Game Industry Promotion Act," the "Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.," and the "Content Industry Promotion Act."

Notwithstanding Paragraph 1 of this Article, even where the purpose of collection or the purpose for which the information was provided has been achieved, the Company retains user information for a certain period prescribed by relevant statutes where there is a need to preserve it under the provisions of statutes such as the Commercial Act, or where there are grounds for information protection under internal policy or other relevant statutes. Article 4 (Sharing and Provision of Personal Information)

The Company uses a Member's personal information within the scope stated in the purposes of collecting and using personal information, and does not use it beyond the above scope, or provide or share it with others or other institutions, without the Member's prior consent. However, exceptions apply where the Member has consented in advance, or where the Member engages in conduct that violates the Company's Terms of Service or policies and operating rules separately established by the Company, and legal measures are required pursuant to relevant laws or for investigative purposes in accordance with the procedures and methods prescribed by statute, or where there is a request from a relevant investigative agency.
The Company may provide or share a Member's personal information with partners for business reasons such as providing customized services for each Member or user and various other services. However, when providing or sharing personal information, the Company will, before providing the information, go through a procedure of notifying in advance and obtaining consent regarding the partner's name, the partnership purpose, the scope of personal information provided or shared, and how long it will be used/retained; and where the Member does not consent, it will not provide or share the information with the partner.
"Where the Member has consented in advance" means where the Member has consented to the provision of personal information to a third party while participating in various promotions such as using a partner service, entering an event, participating in user research, or using a donation service. Article 5 (Rights of Members and Legal Representatives and How to Exercise Them)

A Member may at any time view, inquire about, or modify their own personal information, and may also request cancellation of membership or deletion of personal information. However, if personal information necessary for service provision is deleted, the related service may not be provided.
Where a Member requests correction or deletion of their personal information, the Company takes the necessary measures immediately after verifying the Member's identity. 1. 회원의 개인정보는 원칙적으로 개인정보의 수집 및 이용목적이 달성되면 개인정보보호법이 정하는 바에 따라 복구 또는 재생되지 않도록 파기 합니다. 회사는 약관 및 내부 정책에 따라 부정 이용의 방지를 위하여 회원탈퇴 시 개인정보를 완전히 삭제합니다.
2. 본 조 1항에도 불구하고 수집 목적 또는 제공 받은 목적이 달성된 경우에도 상법 등 법령의 규정에 의하여 보존할 필요성이 있는 경우 및 내부방침 기타 관련법령에 의한 정보보호 사유가 있는 경우 회사는 관련 법령에서 정한 일정한 기간 동안 이용자 정보를 보관합니다. 이 경우 회사는 보관하는 정보를 그 보관의 목적으로만 이용하며 보존 기간은 아래와 같습니다.

5) 표시/광고에 관한 기록
- 보존 근거: 전자상거래 등에서의 소비자보호에 관한 법률
- 보존 기간: 6개월
6) 본인 확인에 관한 기록
- 보존 근거: 정보통신망 이용촉진 및 정보보호 등에 관한 법률
- 보존 기간: 6개월
7) 서비스 이용 관련 개인 정보(접속기록, 이용기록, IP정보)
- 보존 근거: 통신비밀보호법
- 보존 기간: 3개월

제4조 개인정보의 공유 및 제공
1. 회사는 회원의 개인정보를 개인정보의 수집 및 이용목적에서 고지한 범위 내에서 이용하며, 회원의 사전 동의 없이 위의 범위를 초과하여 이용하거나 타인 또는 타 기관에 제공 또는 공유하지 않습니다. 다만, 회원이 사전에 동의한 경우나 회사의 이용약관 또는 회사가 별도로 정한 정책 및 운영 규정에 어긋나는 행위를 하여 관련법에 의거하거나 수사목적으로 법령에 정해진 절차와 방법에 따라 법적인 조치가 요구되거나 관련 수사기관의 요구가 있는 경우는 예외로 합니다.
2. 회사는 회원 또는 이용자 별 맞춤 서비스, 기타 다양한 서비스 제공 등의 사업적인 이유로 회원의 개인정보를 제휴사에 제공하거나 또는 공유할 수 있습니다. 그러나 개인정보를 제공, 정보를 공유할 경우에는 정보 제공 이전에 제휴사명, 제휴 목적, 제공 또는 공유되는 개인정보의 범위, 그리고 언제까지 이용/보관되는지에 대해 사전에 알리고 동의를 구하는 절차를 거치게 되며, 회원이 동의하지 않는 경우에는 제휴사에 제공 또는 공유하지 않습니다.
3. 회원이 사전에 동의한 경우란, 제휴 서비스 이용 혹은 이벤트 응모, 사용자 리서치, 기부 서비스 이용 등 여러 프로모션에 참여하면서 개인정보 제3자 제공에 대해 동의한 경우입니다. 이러한 경우에도 회사는 회원에게 개인정보를 제공받는 자, 그의 이용목적, 제공되는 개인정보의 항목, 개인정보의 보유 및 이용 기간을 사전에 고지하고 이에 대해 명시적·개별적으로 동의를 얻습니다. 이와 같은 모든 과정에 있어서 회사는 회원의 의사에 반하여 추가적인 정보를 수집하거나, 동의의 범위를 벗어난 정보를 제3자와 공유하지 않습니다.

제5조 (회원 및 법정대리인의 권리와 그 행사 방법)
1. 회원은 언제든지 이용자 본인의 개인정보를 확인, 조회하거나 수정할 수 있으며 가입 해지 또는 개인정보의 삭제를 요청할 수도 있습니다. 단, 서비스 제공을 위해 필요한 개인정보를 삭제하는 경우 관련 서비스를 제공받지 못할 수 있습니다.
2. 회원이 자신의 개인정보에 대한 정정 또는 삭제를 요구하는 경우 회사는 본인 여부를 확인한 후 바로 필요한 조치를 취합니다. 또한, 이용약관에 따른 이용 제한 시 개인정보 보호 책임자의 판단 하에 회원 ID 삭제 등 개인정보를 파기할 수 있습니다.
3. 회사는 만 14세 미만의 아동의 개인정보를 수집ㆍ이용ㆍ제공하는 경우 반드시 법정대리인의 동의를 받습니다.
4. 회원의 개인정보에 대한 열람, 수정은 본인 또는 만 14세 미만 아동의 법정대리인 요구에 따라 본인 여부 확인 후 가능합니다.
5. 개인정보의 오류에 대한 정정을 요청하신 경우에는 정정을 완료하기 전까지 당해 개인정보를 이용 또는 제공하지 않습니다. 또한 잘못된 개인정보를 제3자에게 이미 제공한 경우에는 정정 처리 결과를 제3자에게 지체 없이 통지하여 정정이 이루어지도록 합니다.
6. 회사는 회원의 요청으로 해지 또는 삭제된 개인정보에 대해 "회사가 수집하는 개인정보의 보유 및 이용기간"에 명시된 바에 따라 처리하고 그 외의 용도로 열람 또는 이용할 수 없도록 처리하고 있습니다.

제6조 (개인정보 자동수집 장치의 설치, 운영 및 그 거부에 관한 사항)
1. 수집항목: 방문 기록, 접속IP정보, 서비스 이용 기록. 광고 식별자, 이통통신 단말 종류, 모델명, 운영체제, OS버전, 지역, 최초 실행 수, 앱 업데이트, 쿠키(쿠키는 서비스를 운영하는데 이용되는 서버(http)가 이용자의 단말기에게 보내는 소량의 정보이며 이용자 단말에 저장되기도 합니다.)
2. 쿠키사용 유형 및 방법:
1) Google Analytics: Google에서 제공하는 행태 정보 분석도구를 이용하고 있으며 GA는 쿠키(Cookie)를 통하여 당사 서비스 이용자의 주요 행동(행태 정보)를 수집합니다. 수집한 정보로 이용자 개인을 식별 할 수는 없으나 아래 방법으로 거부하실 수 있습니다.
3. 쿠키의 설치∙운영 및 거부 방법: 수집된 쿠키는 미국에 소재한 Google, Facebook으로 이전되어 저장됩니다. 아래 방법을 통해 쿠키 저장을 거부 할 수 있습니다. 1) 아이폰의 경우: Safari App > 방문 기록 및 웹사이트 데이터 지우기 > 확인 2) Chrome의 경우: 크롬 App > 오른쪽 상단 더 보기 > 방문 기록 인터넷 사용 기록 삭제 > 기간 선택 > 쿠키 및 사이트 데이터'와 '캐시 된 이미지 또는 파일' 옆의 체크박스를 선택 > 인터넷 사용기록 삭제

제7조 (개인정보 파기 절차 및 방법)
회원의 개인정보는 원칙적으로 개인정보의 수집 및 이용목적이 달성되면 지체없이 파기합니다. 개인정보 파기 절차 및 방법은 아래와 같습니다.
1. 파기절차
회사는 보존 근거에 따라 보존 기간 동안에 개인정보를 보관한 후, 복구 또는 재생되지 않도록 파기합니다.
2. 파기방법
1) 종이에 출력된 개인정보는 분쇄기로 분쇄하거나, 소각을 통하여 파기합니다.
2) 전자적 파일 형태로 저장된 개인정보는 기록을 복구 및 재생되지 않도록 삭제합니다.

제8조 (개인정보의 기술적/관리적 보호 대책)
1. 회원의 개인정보는 이용자 자신이 설정한 비밀번호에 의해 우선적으로 보호되고 있습니다. 따라서 회원은 절대로 비밀번호를 타인에게 알려주거나 공유해선 안되며, 회사 서비스의 이용 완료 후에는 반드시 로그아웃(LOG-OUT)을 이용하여 웹 브라우저를 종료하여야 합니다. 특히, 다른 사람과 컴퓨터를 공유하여 사용하거나 공공장소에서 이용한 경우에는 타인에게 개인정보가 알려지는 것을 막기 위하여 위 절차는 반드시 필요합니다.
2. 회사는 회원의 개인정보를 처리함에 있어 개인정보가 분실, 도난, 누출, 변조 및 훼손되지 아니하도록 안전성 확보를 위하여 다음과 같은 기술적 내지 관리적 대책을 강구하고 있습니다.
1) 기술적 대책
- 회원의 비밀번호는 암호화 처리되어 이용자 개개인의 비밀번호를 알 수 없게 되어 있습니다.
- 개인정보의 훼손에 대비하여 정보를 수시로 백업하고 있으며 최신의 백신 프로그램을 이용하여 회원의 개인정보와 자료가 누출되거나 손상되지 않도록 하고 있습니다.
- 암호화 통신 등을 통하여 네트워크상에서 개인정보를 안전하게 전송할 수 있도록 하고 있습니다.
- 침입 차단시스템을 이용하여 외부로부터의 무단 접근을 통제하고 있으며 기타 시스템적으로 보완성을 확보하기 위한 가능한 모든 기술적 장치를 갖추려 노력하고 있습니다.
2) 관리적 대책
- 개인정보보호 책임자와 최소한으로 구성된 인원들에 대해서만 개인정보 관련 처리를 한정시키고 있으며 기타 인원에 대해서는 개인정보에 대한 접근 권한을 제한하고 있습니다.
- 개인정보처리인원에 대한 교육을 통하여 개인정보보호 의무 등 관련된 의무를 항상 강조하고 있으며 개인정보 처리방침 이행사항 및 담당자의 준수 여부를 수시로 확인하여 문제가 발견될 경우 즉시 수정하고 바로 잡을 수 있도록 최선의 노력을 기울이고 있습니다.
3. 회사는 회원 자신의 실수 또는 부주의 기타 기본적인 인터넷의 위험으로 인해 발생하는 개인정보 유출 및 훼손에 대해서는 어떠한 책임도 부담하지 않습니다.

제9조 (개인정보보호 책임자 및 담당 부서의 연락처)
회사는 개인정보를 보호하는데 있어 회사의 귀책 사유로 이용자에게 고지한 사항들에 반하는 사고가 발생할 시에 개인정보보호책임자가 모든 책임을 집니다. 그러나 기술적인 보완조치를 했음에도 불구하고, 해킹 등 네트워크상의 위험성에 의해 발생하는 예기치 못한 사고로 인한 정보 훼손, 침해, 누설되는 경우나 이용자 과실로 발생된 개인 정보 유출로 인한 문제에 대해 회사는 일체의 책임을 지지 않습니다.

이용약관
제1조 (목적)
이 약관은 주식회사 리턴픽셀(이하 "회사"라 합니다)가 제공하는 게임 서비스 및 이에 부수하는 네트워크, 웹사이트, 기타 서비스(이하 "서비스"라 합니다)의 이용에 대한 회사와 회원간의 권리ㆍ의무 및 책임사항, 기타 필요한 사항을 규정함을 목적으로 합니다.

제2조 (용어의 정의)
1. 이 약관에서 사용하는 용어의 정의는 다음과 같습니다.
1) "회원"이란 이 약관에 따라 이용계약을 체결하고, 회사가 제공하는 서비스를 이용하는 자를 의미합니다.
2) "임시회원"이란 인증을 하지 않거나 게스트 로그인 모드를 통해 서비스를 이용하는 회원을 의미합니다.
3) "디바이스"란 콘텐츠를 다운로드받거나 설치하여 사용할 수 있는 기기로서, 휴대폰, 스마트폰, 휴대 정보 단말기(PDA), 태블릿 등을 의미합니다.
4) "계정정보"란 회원의 회원 번호와 외부계정정보, 기기 정보, 별명, 프로필 사진, 친구목록 등 회원이 회사에 제공한 정보와 게임 이용정보 (캐릭터 정보, 아이템, 레벨 등), 이용요금 결제 정보 등을 통칭합니다.
5) "콘텐츠"란 디바이스로 이용할 수 있도록 회사가 서비스 제공과 관련하여 디지털 방식으로 제작한 유료 또는 무료의 내용물 일체(게임 및 네트워크 서비스, 애플리케이션, 게임 머니, 게임 아이템 등)를 의미합니다.
6) "유료 결제"란 서비스 내 콘텐츠 등을 구매 또는 이용하기 위해 회사가 인정하는 결제업체를 통한 결제 행위를 의미합니다.
7) "오픈마켓"이란 디바이스에서 게임 콘텐츠를 설치하고 결제할 수 있도록 구축된 전자상거래 환경을 의미합니다.
8) "결제업체"라 함은 신용카드, 휴대폰 결제 등 오픈마켓에서 사용 가능한 전자 지급 수단을 제공하는 업체를 의미합니다.
9) "애플리케이션"이란 회사가 제공하는 서비스를 이용하기 위하여 디바이스를 통해 다운로드 받거나 설치하여 사용하는 프로그램 일체를 의미합니다.
10) "게임 서비스"라 함은 회사가 제공하는 서비스의 하나로서 회원이 디바이스에서 실행하는 게임 및 이에 부수하는 서비스를 의미합니다.
2. 이 약관에서 사용하는 용어의 정의는 본 조 제1항에서 정하는 것을 제외하고는 관계 법령 및 서비스 별 정책에서 정하는 바에 의하며, 이에 정하지 아니한 것은 일반적인 상 관례에 따릅니다.

제3조 (회사 정보 등의 제공)
회사는 관계 법령에 따라 다음 각호의 사항을 회원이 알아보기 쉽도록 표시합니다.
1. 상호 및 대표자의 성명, 영업소 소재지 주소 및 전화번호, 전자우편주소
2. 이용 약관 및 개인정보처리방침
3. 사업자 등록 번호 및 통신 판매업 신고 번호

제4조 (약관의 효력 및 적용과 변경)
1. 이 약관은 회원이 약관에 동의함과 동시에 효력이 발생합니다. 회사는 이 약관의 내용을 회원이 알 수 있도록 게임 서비스 내 또는 그 연결 화면에 게시합니다. 이 경우 이 약관의 내용 중 서비스 중단, 청약 철회, 환급, 계약 해제, 해지, 회사의 면책사항 등과 같은 중요한 내용은 굵은 글씨, 색채, 부호 등으로 명확하게 표시하거나 별도의 연결 화면 등을 통하여 회원이 알아보기 쉽게 처리합니다.
2. 회사가 약관을 개정할 경우에는 적용 일자 및 개정내용, 개정 사유 등을 명시하여 최소한 그 적용일 7일 이전부터 게임 서비스 내 또는 그 연결 화면에 게시하여 회원에게 공지합니다. 다만, 변경된 내용이 회원에게 불리하거나 중대한 사항의 변경인 경우에는 그 적용일 30일 이전까지 본문과 같은 방법으로 공지하고 제26조 제1항의 방법으로 회원에게 통지합니다. 이 경우 개정 전 내용과 개정 후 내용을 명확하게 비교하여 회원이 알기 쉽도록 표시합니다.
3. 회사가 약관을 개정할 경우 개정약관 공지 후 개정약관의 적용에 대한 회원의 동의 여부를 확인합니다. 회사는 제2항의 공지 또는 통지를 할 경우 회원이 개정약관에 대해 동의 또는 거부의 의사표시를 하지 않으면 동의한 것으로 볼 수 있다는 내용도 함께 공지 또는 통지를 하며, 회원이 이 약관 시행일까지 거부의 의사표시를 하지 않는다면 개정약관에 동의한 것으로 볼 수 있습니다. 회원이 개정약관에 대해 동의하지 않는 경우 회사 또는 회원은 서비스 이용계약을 해지할 수 있습니다.
4. 회사는 회원이 회사와 이 약관의 내용에 관하여 질의 및 응답을 할 수 있도록 조치를 취합니다.
5. 회사는 「전자상거래 등에서의 소비자보호에 관한 법률」, 「약관의 규제에 관한 법률」, 「게임산업진흥에 관한 법률」, 「정보통신망 이용촉진 및 정보보호 등에 관한 법률」, 「콘텐츠산업진흥법」 등 관련 법령을 위배하지 않는 범위에서 이 약관을 개정할 수 있습니다.

제5조 (이용계약의 체결 및 적용)
1. 이용계약은 회원이 되고자 하는 자(이하 "가입 신청자"라 합니다.)가 이 약관의 내용에 대하여 동의를 한 다음 서비스 이용 신청을 하고, 회사가 그 신청에 대해서 승낙함으로써 체결됩니다.
2. 회사는 가입 신청자가 이용신청을 승낙한 때부터 서비스를 개시합니다. 단, 일부 서비스의 경우에는 회사의 필요에 따라 지정된 일자부터 서비스를 개시할 수 있으며, 다음과 같은 경우에는 서비스의 제공을 거절 또는 중단할 수 있습니다.
1) 이용 신청서 내용을 허위로 기재하거나 이용신청 요건을 충족하지 못한 경우
2) 회사가 서비스를 제공하지 않은 국가에서 비정상적이거나 우회적인 방법을 통해 서비스를 이용하는 경우
3) 「게임산업진흥에 관한 법률」 등 관련 법령에서 금지하는 행위를 할 목적으로 신청하는 경우
4) 사회의 안녕과 질서 또는 미풍양속을 저해할 목적으로 신청한 경우
5) 부정한 용도로 게임 서비스를 이용하고자 하는 경우
6) 영리를 추구할 목적으로 게임 서비스를 이용하고자 하는 경우
7) 청소년(18세 미만의 자로서 "초·중등교육법" 제2조의 규정에 의한 고등학교에 재학 중인 학생을 포함)이 법정대리인의 동의를 얻지 아니하거나 동의를 얻었음을 확인할 수 없는 경우
8) 그 밖에 각호에 준하는 사유로서 승낙이 부적절하다고 판단되는 경우
3. 회사는 다음 각호의 어느 하나에 해당하는 경우 그 사유가 해소될 때까지 승낙을 유보할 수 있습니다.
1) 회사의 설비에 여유가 없거나, 특정 디바이스의 지원이 어렵거나, 기술적 장애가 있는 경우
2) 서비스 상의 장애 또는 서비스 이용요금, 결제수단의 장애가 발생한 경우
3) ‘회원’으로서 부적절한 행위를 할 우려가 있다고 인정되는 경우
4) 그 밖의 각호에 준하는 사유로서 이용신청의 승낙이 어렵다고 판단되는 경우
4. 회사는 서비스를 신청한 회원에 대해 회사 정책 및 관련법령에 따라 회원의 종류 및 등급별로 구분하여 서비스 범위, 이용시간, 서비스 메뉴 등을 세분화하여 이용에 차등을 둘 수 있습니다. 회사는 서비스 범위 조정이나 일부 서비스의 제공을 위해 추가 정보를 요청할 수 있습니다.

제6조 (운영정책)
1. 약관을 적용하기 위하여 필요한 사항과 약관에서 구체적 범위를 정하여 위임한 사항을 게임 서비스 운영정책(이하 "운영정책"이라 합니다)으로 정할 수 있습니다.
2. 회사는 운영정책의 내용을 회원이 알 수 있도록 게임 서비스 내 또는 그 연결 화면에 게시합니다.
3. 운영정책을 개정하는 경우에는 제4조 제2항의 절차에 따릅니다. 다만, 운영정책 개정 내용이 다음 각호의 어느 하나에 해당하는 경우에는 제2항의 방법으로 사전에 공지합니다.
1) 약관에서 구체적으로 범위를 정하여 위임한 사항을 개정하는 경우
2) 회원의 권리·의무와 관련 없는 사항을 개정하는 경우
3) 운영정책의 내용이 약관에서 정한 내용과 근본적으로 다르지 않고 회원이 예측할 수 있는 범위 내에서 운영정책을 개정하는 경우

제7조 (개인정보의 보호 및 사용) 1. 회사는 관련 법령이 정하는 바에 따라 회원의 개인정보를 보호하기 위해 노력하며, 개인정보의 보호 및 사용에 대해서는 관련 법령 및 회사의 개인정보처리방침에 따릅니다. 다만, 회사가 제공하는 서비스 이외의 링크된 서비스에서는 회사의 개인정보처리방침이 적용되지 않습니다.
2. 서비스의 특성에 따라 회원의 개인정보와 관련이 없는 별명‧캐릭터 사진‧상태정보 등 자신을 소개하는 내용이 공개될 수 있습니다.
3. 회사는 관련 법령에 의해 관련 국가기관 등의 요청이 있는 경우를 제외하고는 회원의 개인정보를 본인의 동의 없이 타인에게 제공하지 않습니다.
4. 회사는 회원의 귀책 사유로 개인정보가 유출되어 발생한 피해에 대하여 책임을 지지 않습니다.

제8조 (회사의 의무) 1. 회사는 관련 법령, 이 약관에서 정하는 권리의 행사 및 의무의 이행을 신의에 따라 성실하게 준수합니다.
2. 회사는 회원이 안전하게 서비스를 이용할 수 있도록 개인정보(신용정보 포함)보호를 위해 보안시스템을 갖추어야 하며 개인정보처리방침을 공시하고 준수합니다.
3. 회사는 이 약관 및 개인정보처리방침에서 정한 경우를 제외하고는 회원의 개인정보가 제3자에게 공개 또는 제공되지 않도록 합니다.
4. 회사는 계속적이고 안정적인 서비스의 제공을 위하여 서비스 개선을 하던 중 설비에 장애가 생기거나 데이터 등이 멸실·훼손된 때에는 천재지변, 비상사태, 현재의 기술로는 해결이 불가능한 장애나 결함 등 부득이한 사유가 없는 한 지체 없이 이를 수리 또는 복구하도록 최선의 노력을 다합니다.

제9조 (회원의 의무)
1. 회원은 회사에서 제공하는 서비스의 이용과 관련하여 다음 각호에 해당하는 행위를 해서는 안 됩니다.
1) 고객 문의, 유료 콘텐츠 복구 및 환불요청, 이벤트 당첨 등으로 인해 회사에 개인정보 제공 시 실명이 아닌 정보 또는 다른 사람의 정보를 사용하거나, 허위의 사실을 기재하는 행위
2) 다른 회원의 회원 계정정보를 도용, 부정하게 사용하거나, 타인의 신용카드, 유/무선전화, 은행 계좌 등을 무단으로 도용하여 유료콘텐츠를 구매하는 행위
3) 비정상적인 방법을 통해 ID, 캐릭터, 아이템, 게임 머니 등을 매매 또는 증여하거나, 이를 취득하여 이용하는 행위
4) 회사의 서비스 및 제공된 애플리케이션을 이용하여 얻은 정보를 회사의 사전 승낙 없이 복제, 유통, 조장하거나 상업적으로 이용하는 행위, 또는 알려지거나 알려지지 않은 버그를 악용하여 서비스를 이용하는 행위
5) 회사의 서비스 및 제공된 애플리케이션을 이용하여 자신 또는 타인으로 하여금 재산상 이익을 얻게 하는 행위
6) 회사의 지적재산권, 제3자의 지적재산권, 초상권 등 기타 권리를 침해하거나 다른 회원의 개인정보를 수집, 저장, 유포, 게시하는 행위
7) 제3자를 기망하여 이득을 취하거나 회사가 제공하는 서비스를 불건전하게 이용하여, 제3자에게 피해를 주는 행위
8) 회사 및 기타 제3자의 명예를 훼손하거나 업무에 방해가 되는 행위
9) 음란, 저속한 정보를 교류, 게재하거나 음란 사이트를 연결(링크)하거나 승인되지 않은 광고 및 홍보물 게재하는 행위
10) 수치심이나 혐오감 또는 공포심을 일으키는 말이나 음향, 글이나 화상 또는 영상을 상대방에게 전송, 도달, 유포하는 행위
11) 재물을 걸고 도박 하는 등 사행 행위를 유도하거나 참여하는 행위
12) 관련 법령에 의하여 그 전송 또는 게시가 금지되는 정보(컴퓨터 프로그램) 또는 컴퓨터 소프트웨어, 하드웨어, 전기 통신 장비의 정상적인 가동을 방해, 파괴할 목적으로 고안된 소프트웨어 바이러스, 기타 다른 컴퓨터 코드, 파일, 프로그램을 포함하고 있는 자료를 전송, 게시, 유포, 사용하는 행위
13) 회사로부터 특별한 권리를 부여 받지 않고 애플리케이션을 변경하거나 애플리케이션에 다른 프로그램을 추가 또는 삽입하거나 서버를 해킹, 역 설계하거나, 소스 코드나 애플리케이션 데이터의 유출 및 변경, 별도의 서버를 구축하거나 웹사이트의 일부분을 임의로 변경 또는 도용하여 회사를 사칭하는 행위
14) 회사의 직원이나 운영자를 가장하거나 사칭, 또는 타인의 명의를 도용하여 글을 게시하거나 메일을 발송하는 행위
15) 회사의 동의 없이 영리, 영업, 광고, 정치 활동, 불법 선거운동 등을 목적으로 서비스를 사용하는 행위
16) 서비스의 운영을 고의로 방해하거나 서비스의 안정적 운영을 방해할 수 있는 정보 등을 전송하는 행위
17) 허위내용을 사실인 것처럼 유포하여 다른 회원에게 혼란을 야기하거나 기타 회사의 정상적인 서비스운영을 방해하는 행위
18) 욕설/비방, 채팅/게시판 도배, 게임진행 방해 등 다른 회원의 원활한 서비스 이용을 방해하는 행위
19) 비정상적인 방법으로 게임 시스템 설계상 제한을 회피하여 부당한 이익을 취하는 행위(어뷰징)
20) 회사 또는 오픈마켓 사업자 또는 플랫폼사업자가 제공하는 결제, 환불 정책을 악용하여 부당한 이익을 취하는 행위
21) 회사 상담사의 인권을 침해하여 업무를 방해하는 행위
22) 기타 공공질서 및 미풍양속을 위반하거나 불법적, 부당한 행위 및 관계 법령에 위배되는 행위
2. 회원의 계정 및 디바이스에 관한 관리 책임은 회원에게 있으며, 이를 타인이 이용하도록 하게 하여서는 안 됩니다. 디바이스의 관리 부실이나 타인에게 이용을 승낙함으로 인해 발생하는 손해에 대해서 회사는 책임을 지지 않습니다.
3. 회원은 각 오픈마켓에서 부정한 결제가 이루어지지 아니하도록 결제 비밀번호 기능을 설정하고 관리하여야 합니다. 회원의 부주의로 인하여 발생하는 손해에 대해 회사는 책임지지 않습니다
4. 회사는 다음 각호의 행위의 구체적인 내용을 정할 수 있으며, 회원은 이를 따라야 합니다.
1) 회원의 계정명, 캐릭터명, 길드명, 기타 게임 내에서 사용하는 명칭
2) 채팅 내용과 방법
3) 게시판 이용 및 서비스 이용 방법
4) 제휴 서비스 정책 등 외부 모바일 플랫폼 제휴 서비스 정책
5) 게임플레이 방법에 대한 제한
6) 기타 회원의 서비스 이용에 대한 본질적 권리를 침해하지 않는 범위 내에서 회사가 서비스 운영상 필요하다고 인정하는 사항

제10조 (서비스의 제공)
1. 회사는 제5조의 규정에 따라 이용계약이 완료된 회원에게 그 즉시 서비스를 이용할 수 있도록 합니다. 다만, 일부 서비스의 경우 회사의 필요에 따라 지정된 일자부터 서비스를 개시할 수 있습니다.
2. 회사는 회원에게 게임 서비스를 제공할 때 이 약관에 정하고 있는 서비스를 포함하여 기타 부가적인 서비스를 함께 제공할 수 있습니다.
3. 회사는 회원의 등급을 구분하고 이용 시간, 이용 횟수, 제공 서비스의 범위 등을 세분화하여 이용에 차등을 둘 수 있습니다.

제11조 (서비스의 이용)
1. 게임 서비스는 회사의 영업 방침에 따라 정해진 시간 동안 제공합니다. 회사는 게임 서비스 제공 시간을 게임 애플리케이션 초기화면이나 게임 서비스 공지사항에 적절한 방법으로 안내합니다. 별도의 표시 또는 공지가 없는 경우는 24시간 제공을 기본으로 합니다.
2. 제1항에도 불구하고 회사는 다음 각호의 경우에는 서비스의 전부 또는 일부를 일시 정지할 수 있습니다. 이 경우 회사는 사전에 그 정지의 사유와 기간을 게임 애플리케이션 초기화면이나 게임 서비스 공지사항 등에 공지합니다. 다만, 사전에 공지할 수 없는 부득이한 사정이 있는 경우 사후에 공지할 수 있습니다.
1) 시스템 정기점검, 서버의 증설 및 교체, 네트워크의 불안정 등의 시스템 운영상 필요한 경우
2) 정전, 서비스 설비의 장애, 서비스 이용 폭주, 기간통신사업자의 설비 보수 또는 점검 등으로 인하여 정상적인 서비스 제공이 불가능한 경우
3) 전시, 사변, 천재지변 또는 이에 준하는 국가비상사태 등 회사가 통제할 수 없는 상황이 발생한 경우
4) 관계 법령, 정부 및 회사의 정책에서 특정 시간 또는 횟수 제한 등의 방법으로 서비스 제공을 금지하는 경우
3. 디바이스를 위한 전용 애플리케이션 또는 네트워크를 이용하여 서비스를 제공합니다. 회원은 애플리케이션을 다운로드하여 설치하거나 네트워크를 이용하여 무료 또는 유료로 서비스를 이용할 수 있습니다.
4. 유료 콘텐츠의 경우에는 해당 서비스에 명시된 요금을 지급하여야 이용할 수 있습니다. 네트워크를 통해 애플리케이션을 다운로드하거나 서비스를 이용하는 경우에는 가입한 이동통신사에서 정한 별도의 요금이 발생할 수 있습니다.
5. 다운로드하여 설치한 애플리케이션 또는 네트워크를 통해 이용하는 서비스의 경우에는 디바이스 또는 이동통신사의 특성에 맞도록 제공됩니다. 디바이스의 변경, 번호 변경 또는 해외 로밍의 경우에는 콘텐츠의 전부 또는 일부의 이용이 불가능할 수 있으며, 이 경우 회사는 책임을 지지 않습니다.
6. 다운로드하여 설치한 애플리케이션 또는 네트워크를 통해 이용하는 서비스의 경우에는 백그라운드 작업이 진행될 수 있습니다. 이 경우 디바이스 또는 이동통신사의 특성에 맞도록 추가요금이 발생할 수 있으며 이와 관련하여 회사는 책임을 지지 않습니다.
7. 회사는 서비스 이용을 신청한 회원에게 원활하게 서비스를 제공하기 위해, 개별 게임 클라이언트, 보안프로그램, 결제 모듈 등 서비스 이용에 필요한 프로그램을 회원의 추가 동의 없이 설치하거나 변경(업데이트)할 수 있습니다. 단, 광고 프로그램 등 게임서비스 이용과 무관한 프로그램의 설치 시에는 회원에게 고지하고 동의를 받아 설치합니다.
8. 회사는 게임 내용의 변경, 밸런스 유지, 아이템 정책 등에 따라 기존 아이템의 기능 등을 변경하거나 사용이 불가능하도록 변경할 수 있습니다. 이 때 사용기간이 경과하지 않은 유료 아이템 사용이 불가능하게 되는 경우에는 유료로 구매한 아이템의 잔여 사용 기간에 상당하는 등가의 유료 아이템 또는 포인트 등으로 보상합니다.

제12조 (서비스의 변경 및 중단)
1. 회사는 원활한 게임 서비스 제공을 위해 운영상 또는 기술상의 필요에 따라 서비스를 변경할 수 있으며, 변경 전에 해당 내용을 게임 서비스 내에 공지합니다. 다만, 버그, 오류 등의 수정이나 긴급 업데이트 등 부득이하게 변경할 필요가 있는 경우 또는 중대한 변경에 해당하지 않는 경우에는 사후에 공지할 수 있습니다.
2. 회사는 영업양도, 분할, 합병 등에 따른 영업의 폐지, 게임 제공의 계약만료, 당해 게임 서비스의 현저한 수익 악화 등 경영상의 중대한 사유로 인해 게임 서비스를 지속하기 어려운 경우에는 서비스 전부를 중단할 수 있습니다. 이 경우 중단 일자 30일 이전까지 중단 일자, 중단 사유, 보상 조건 등을 게임 애플리케이션 초기화면 또는 그 연결화면을 통해 공지하고 제26조 제1항의 방법으로 회원에게 통지합니다.
3. 회사가 제2항에 따라 게임 서비스를 종료하는 경우 회원은 무료서비스 및 사용 기간이 남아 있지 않은 유료서비스·계속적 유료 이용계약·기간제 유료콘텐츠에 대하여 손해배상을 청구할 수 없습니다. 사용 기간에 제한이 없는 유료 게임아이템은 서비스 종료일까지를 해당 유료 게임아이템의 사용 기간으로 봅니다.
4. 회사는 회사가 제공하는 유료서비스의 중지·장애와 관련하여 다음 각 호에 따라 보상하며, 회원은 회사에 대하여 별도의 손해배상을 청구할 수 없습니다.
1) 회사의 귀책사유로 사전고지 없이 1일 4시간(누적 시간) 이상 연속하여 서비스가 중지되거나 장애가 발생한 경우 기간제 유료서비스 이용 계정에 한하여 서비스 중지·장애 시간의 3배에 해당하는 이용시간을 무료로 연장합니다.
2) 회사가 서버 점검 등의 사유로 서비스 중지·장애를 사전에 고지하였으나, 서비스 중지·장애 시간이 10시간을 초과하는 경우에는 정액제 서비스 등 기간제 유료서비스 계정에 한하여 그 초과된 시간만큼 이용시간을 무료로 연장합니다.
3) 이용시간 연장이 불가능한 유료서비스의 경우 회사는 회사의 선택으로 등가의 유료 서비스 등으로 서비스의 중지·장애 내역을 보상합니다.

제13조 (정보의 수집)
1. 회사는 회원 간에 이루어지는 채팅 내용을 저장, 보관할 수 있으며 이 정보는 회사만이 보유합니다. 회사는 회원 간의 분쟁 조정, 민원 처리 또는 게임 질서의 유지를 위한 경우에 한하여, 제3자는 법령에 따라 권한이 부여된 경우에 한하여 이 정보를 열람할 수 있습니다.
2. 회사 또는 제3자가 제1항에 따라 채팅 정보를 열람할 경우 회사는 사전에 열람의 사유 및 범위를 해당 회원에게 고지합니다. 다만, 제10조 제1항에 따른 금지 행위의 조사, 처리, 확인 또는 그 행위로 인한 피해 구제와 관련하여 이 정보를 열람해야 할 경우에는 사후에 고지할 수 있습니다.
3. 회사는 서비스의 원활하고 안정적인 운영 및 서비스 품질의 개선을 위하여 회원의 개인정보를 제외한 회원의 디바이스 정보(설정, 사양, 운영체제, 버전 등)를 수집 ‧ 활용할 수 있습니다.
4. 회사는 서비스 개선 및 회원 대상 서비스 소개 등을 위한 목적으로 회원에게 추가정보를 요청할 수 있습니다. 이 요청에 대해 회원은 승낙하거나 거절할 수 있으며, 회사가 이 요청을 할 경우에는 회원이 이 요청을 거절할 수 있다는 뜻을 함께 고지합니다.

제14조 (광고의 제공)
1. 회사 서비스의 운영과 관련하여 게임서비스 내에 광고를 게재할 수 있습니다. 또한 수신에 동의한 회원에 한하여 전자우편, 문자 서비스(LMS/SMS), 푸시 메시지(Push Notification) 등의 방법으로 광고성 정보를 전송할 수 있습니다. 이 경우 회원은 언제든지 수신을 거절할 수 있으며, 회사는 회원의 수신 거절 시 광고성 정보를 발송하지 아니합니다.
2. 회사가 제공하는 서비스 중의 배너 또는 링크 등을 통해 타인이 제공하는 광고나 서비스에 연결될 수 있습니다.
3. 제2항에 따라 타인이 제공하는 광고나 서비스에 연결될 경우 해당 영역에서 제공하는 서비스는 회사의 서비스 영역이 아니므로 회사가 신뢰성, 안정성 등을 보장하지 않으며, 그로 인한 회원의 손해에 대하여도 회사는 책임을 지지 않습니다. 다만, 회사가 고의 또는 중과실로 손해의 발생을 용이하게 하거나 손해 방지를 위한 조치를 취하지 아니한 경우에는 그러하지 아니합니다.

제15조 (저작권 등의 귀속)
1. 회사가 제작한 게임서비스 내의 콘텐츠에 대한 저작권과 기타 지적재산권은 회사에 귀속합니다. 또한, 게임서비스와 관련하여 회원에게 회사가 정한 이용조건에 따라 게임이나 캐릭터, 게임아이템, 게임 머니 등을 이용할 수 있는 이용권만을 부여하며, 회원은 이를 제3자와 공유하거나 양도, 판매, 담보제공 등의 처분행위를 할 수 없습니다. 또한 본 약관에 의한 게임서비스 이용계약이 종료될 경우 회원은 게임 클라이언트를 포함하여 콘텐츠를 즉시 삭제하여야 합니다.
2. 회원은 회사가 제공하는 게임 서비스를 이용하여 얻은 정보 중에서 회사 또는 제공업체에 지적재산권이 귀속된 정보를 회사 또는 제공업체의 사전 동의 없이 복제⋅전송 등의 방법(편집, 공표, 공연, 배포, 방송, 2차적 저작물 작성 등을 포함합니다. 이하 같습니다)에 의하여 영리 목적으로 이용하거나 타인에게 이용하게 하여서는 안 됩니다.
3. 회원은 게임 내에서 보이거나 게임 서비스와 관련하여 회원 또는 다른 이용자가 게임 애플리케이션 또는 게임 서비스를 통해 업로드 또는 전송하는 대화 텍스트를 포함한 커뮤니케이션, 이미지, 사운드 및 모든 자료 및 정보(이하 "이용자 콘텐츠"라 합니다.)에 대하여 회사가 다음과 같은 방법과 조건으로 이용하는 것을 허락합니다.
1) 해당 이용자 콘텐츠를 이용, 편집 형식의 변경 및 기타 변형하는 것(공표, 복제, 공연, 전송, 배포, 방송, 2차적 저작물 작성 등 어떠한 형태로든 이용 가능하며, 이용 기간과 지역에는 제한이 없음)
2) 이용자 콘텐츠를 제작한 이용자의 사전 동의 없이 거래를 목적으로 이용자 콘텐츠를 판매, 대여, 양도 행위를 하지 않음
4. 게임 에서 보이지 않고 게임 서비스와 일체화 되지 않은 회원의 이용자 콘텐츠(예컨대, 일반 게시판 등에서의 게시물)에 대하여 회사는 회원의 명시적인 동의가 없이 이용하지 않으며, 회원은 언제든지 이러한 이용자 콘텐츠를 삭제할 수 있습니다.
5. 회사는 회원이 게시하거나 등록하는 서비스 내의 게시물에 대해 제10조 제1항에 따른 금지 행위에 해당한다고 판단되는 경우에는 사전 통지 없이 이를 삭제 또는 이동하거나 그 등록을 거절할 수 있습니다.
6. 회사가 운영하는 게시판 등에 게시된 정보로 인하여 법률상 이익이 침해된 회원은 회사에 해당 정보의 삭제 또는 반박 내용의 게재를 요청할 수 있습니다. 이 경우 회사는 신속하게 필요한 조치를 취하고 이를 신청인에게 통지합니다.
7. 회원의 게시물이 타인의 권리를 침해하였음을 이유로 타인으로부터 회사가 손해배상청구 등의 이의 제기를 받은 경우, 게시물을 작성한 회원은 회사의 면책을 위하여 적극적으로 협조하여야 하며, 회사가 면책되지 못한 경우 회원은 그로 인해 발생한 문제에 대해 책임을 부담하여야 합니다.
8. 본 조는 회사가 게임 서비스를 운영하는 동안 유효하며, 회원 탈퇴 후에도 지속적으로 적용됩니다.

제16조 (유료 콘텐츠의 구매, 사용 기간 및 이용)
1. 게임 서비스 내에서 회원이 구매한 유료 콘텐츠는 해당 애플리케이션을 다운로드 받거나 설치한 디바이스에서만 이용할 수 있습니다. 다만, 임시 회원의 경우 애플리케이션을 다운로드 받거나 설치한 디바이스에서만 이용할 수 있습니다.
2. 회원이 구매한 유료 콘텐츠의 이용 기간은 구매 시 명시된 기간에 따릅니다. 다만, 제12조 제2항에 따라 서비스 중단이 이루어지는 경우 기간의 정함이 없는 유료 콘텐츠의 이용 기간은 서비스 중단 공지 시 공지된 서비스의 중단일자까지로 합니다.
3. 회원이 구매한 콘텐츠는 획득 방식에 따라 유료/무료 속성으로 구분되며, 이를 포함한 보유 콘텐츠 중 일부를 사용하였을 경우 유료 속성이 우선 차감되고, 그 이후 무료 속성이 차감됩니다. 유료 속성만 보유 시에 차감 순서는 선입선출 방식(먼저 획득한 순서대로 차감되는 방식)에 따릅니다.
4. 회원은 회사가 별도로 정하여 고지한 방법 이외에는 회원 본인의 계정에서만 구매한 유료 콘텐츠를 이용할 수 있으며, 이를 제3자에게 양도, 대여, 매매할 수 없습니다.

제17조 (회원에 대한 서비스 이용 제한)
1. 회원은 제9조에 따른 회원의 의무를 위반하는 행위를 하여서는 안 되며, 해당 행위를 하는 경우에 회사는 다음 각호의 구분에 따른 회원의 서비스 이용 제한, 관련 정보(글, 사진, 영상 등) 삭제 및 기타의 조치를 포함한 이용 제한 조치를 할 수 있습니다. 이용 제한 조치가 이루어지는 구체적인 사유 및 절차는 제9조 제1항에 따라 개별 게임의 운영정책에서 정합니다.
1) 권한 제한: 일정 기간 채팅 등 일정 권한을 제한
2) 캐릭터 이용 제한: 일정 기간 또는 영구히 회원 캐릭터의 이용을 제한
3) 계정 이용 제한: 일정 기간 또는 영구히 회원 계정의 이용을 제한
4) 회원 이용제한: 일정기간 또는 영구히 회원의 게임서비스 이용을 제한
2. 제1항의 제한이 정당한 경우에 회사는 이용 제한으로 인하여 회원이 입은 손해를 배상하지 않습니다.
3. 회사는 다음 각호의 사유에 대한 조사가 완료될 때까지 해당 계정의 서비스 이용을 정지할 수 있습니다.
1) 이 해킹 또는 도용 당했다는 정당한 신고가 접수된 경우
2) 불법프로그램 사용자 또는 작업장 등 위법행위자로 의심되는 경우
3) 그 밖에 각호에 준하는 사유로 서비스 이용의 잠정 조치가 필요한 경우
4. 제3항의 조사가 완료된 후, 유료 게임 서비스의 경우에는 정지된 시간만큼 회원의 이용 시간을 연장하거나 그에 상당하는 유료서비스 또는 캐쉬 등으로 보상합니다. 다만, 회원이 제3항 각호의 사유에 해당하는 경우에는 그러하지 아니합니다.

제18조 (이용 제한 조치의 사유와 절차)
1. 회사는 제17조 제1항에 따른 이용 제한 조치의 구체적인 사유 및 절차를 제9조 제1항에 따른 금지행위의 내용, 정도, 횟수, 결과 등을 고려하여 운영정책으로 정합니다.
2. 회사가 제18조 제1항에서 정한 이용 제한 조치를 하는 경우에는 다음 각호의 사항을 회원에게 사전 통지합니다. 다만, 긴급히 조치할 필요가 있는 경우에는 사후에 통지할 수 있습니다
1) 이용 제한 조치의 사유
2) 이용 제한 조치의 유형 및 기간
3) 이용 제한 조치에 대한 이의신청 방법

제19조 (이용 제한 조치에 대한 이의신청 절차)
1. 회원이 회사의 이용 제한 조치에 불복하고자 할 때는 이 조치의 통지를 받은 날부터 15일 이내에 불복 이유를 기재한 이의 신청서를 서면, 전자우편 또는 이에 준하는 방법으로 회사에 제출하여야 합니다.
2. 회사는 제1항의 이의신청서를 접수한 날부터 15일 이내에 불복 이유에 대하여 서면, 전자우편 또는 이에 준하는 방법으로 답변합니다. 다만, 회사는 이 기간 내에 답변이 어려운 경우에는 그 사유와 처리 일정을 통지합니다.
3. 회사는 불복 이유가 타당한 경우에는 이에 따른 조치를 취합니다.

제20조 (대금결제)
1. 콘텐츠에 대한 구매 대금의 부과와 납부는 원칙적으로 이동통신사나 오픈마켓 사업자 등에서 정하는 정책이나 방법에 따릅니다. 또한 각 결제수단 별 한도가 회사나 오픈마켓 사업자가 정하는 정책 또는 정부의 방침에 따라 부여되거나 조정될 수 있습니다.
2. 콘텐츠의 구매대금을 외화로 결제하는 경우에는 환율‧수수료 등으로 인하여 실제 청구금액이 서비스의 상점 등에서 표시된 가격과 달라질 수 있습니다.

제21조 (청약 철회 등)
1. 회사와 유료 콘텐츠의 구매에 관한 계약을 체결한 회원은 구매계약일과 콘텐츠 이용 가능일 중 늦은 날부터 7일 이내에 별도의 수수료‧위약금 등의 부담 없이 청약 철회를 할 수 있습니다.
2. 회원은 다음 각호에 해당하는 경우에는 회사의 의사에 반하여 제1항에 따른 청약 철회를 할 수 없습니다. 다만, 가분적 콘텐츠로 구성된 구매계약의 경우에는 가분적 콘텐츠 중 다음 각호에 해당하지 아니하는 나머지 부분에 대하여는 그러하지 아니합니다.
1) 구매 즉시 사용되거나 적용되는 유료 콘텐츠
2) 추가 혜택이 제공되는 경우에 그 추가 혜택이 사용된 콘텐츠
3) 개봉행위를 사용으로 볼 수 있거나 개봉 시 효용이 결정되는 콘텐츠의 개봉행위가 있는 경우
3. 회사는 제2항 각호의 규정에 따라 청약 철회가 불가능한 콘텐츠의 경우에는 그 사실을 회원이 쉽게 알 수 있는 곳에 명확하게 표시하고, 해당 콘텐츠의 시험사용 상품을 제공(한시적 이용의 허용, 체험용 제공 등)하거나 이에 대한 제공이 곤란한 경우에는 콘텐츠에 관한 정보 제공함으로써 회원의 청약 철회의 권리행사가 방해 받지 아니하도록 조치합니다. 만약 회사가 이러한 조치를 하지 아니한 경우에는 제2항 각호의 청약 철회 제한 사유에도 불구하고 회원은 청약 철회를 할 수 있습니다.
4. 제1항 및 제2항에도 불구하고 회원이 구매한 유료 콘텐츠의 내용이 표시․광고의 내용과 다르거나 구매계약의 내용과 다르게 이행된 경우에 해당 콘텐츠가 이용 가능하게 된 날부터 3개월 이내, 그 사실을 안 날 또는 알 수 있었던 날부터 30일 이내에 청약 철회를 할 수 있습니다.
5. 회원이 청약 철회를 할 경우 회사는 오픈 마켓 사업자를 통해 구매내역을 확인합니다. 또한 회사는 회원의 정당한 철회 사유를 확인하기 위해 회원에게서 제공받은 정보를 통해 회원에게 연락할 수 있으며, 추가적인 증빙을 요구할 수 있습니다.
6. 제1항부터 제4항까지의 규정에 따라 청약 철회가 이 회사와 유료 콘텐츠의 구매에 관한 계약을 체결한 회원은 구매계약일과 콘텐츠 이용 가능일 중 늦은 날부터 7일 이내에 별도의 수수료‧위약금 등의 부담 없이 청약 철회를 할 수 있습니다.
7. 미성년자가 디바이스에서 콘텐츠 구매계약을 체결하는 경우, 회사는 법정대리인의 동의가 없으면 미성년자 본인 또는 법정대리인이 그 계약을 취소할 수 있다는 내용을 고지하며, 미성년자가 법정대리인의 동의 없이 구매계약을 체결한 때에는 미성년자 본인 또는 법정대리인은 회사에 그 계약을 취소할 수 있습니다. 다만, 미성년자가 법정대리인이 범위를 정하여 처분을 허락한 재산으로 콘텐츠를 구매한 경우 또는 미성년자가 속임수로써 자기를 성년자로 믿게 하거나 법정대리인의 동의가 있는 것으로 믿게 한 경우에는 취소할 수 없습니다.
8. 콘텐츠 구매계약의 당사자가 미성년자인지 여부는 결제가 진행된 디바이스, 결제 실행자 정보, 결제 수단 명의자 등을 근거로 판단합니다. 또한 회사는 정당한 취소인지를 확인하기 위해 미성년자 및 법정대리인임을 증명할 수 있는 서류의 제출을 요청할 수 있습니다.

제22조 (과오납금의 환급)
1. 회사는 과오납금이 발생하는 경우 과오납금을 회원에게 환급합니다. 다만, 과오납금이 회사의 고의 또는 과실 없이 회원의 과실로 인하여 발생한 경우에는 그 환급에 되는 실제 비용은 합리적인 범위 내에서 회원이 부담합니다.
2. 애플리케이션을 통한 결제는 오픈마켓 사업자가 제공하는 결제방식에 따르며, 결제 과정에서 과오납금이 발생하는 경우, 회사 또는 오픈마켓 사업자에게 환급을 요청하여야 합니다.
3. 애플리케이션의 다운로드 또는 네트워크 서비스의 이용으로 인해 발생한 통신요금(통화료, 데이터 통화료 등)은 환급 대상에서 제외될 수 있습니다.
4. 환급은 서비스를 이용하고 있는 디바이스의 운영체제 종류에 따라 각 오픈마켓 사업자 또는 회사의 환급정책에 따라 진행됩니다.
5. 회사는 과오납금의 환급을 처리하기 위해 회원에게서 받은 정보를 통해 회원에게 연락할 수 있으며, 필요한 정보의 제공을 요청할 수 있습니다. 회사는 회원으로부터 환급에 필요한 정보를 받은 날부터 3영업일 이내에 환급합니다.

제23조 (계약 해지 등)
1. 회원은 언제든지 게임 서비스 이용을 원하지 않는 경우 회원 탈퇴를 통해 이용 계약을 해지할 수 있습니다. 회원 탈퇴로 인해 회원이 게임 서비스 내에서 보유한 게임 이용정보는 모두 삭제되어 복구가 불가능하게 됩니다.
2. 회사는 회원이 이 약관 및 그에 따른 운영정책, 서비스 정책에서 금지하는 행위를 하는 등 본 계약을 유지할 수 없는 중대한 사유가 있는 경우에는 상당한 기간 전에 최고하고 기간을 정하여 서비스 이용을 중지하거나 이용계약을 해지할 수 있습니다.
3. 제1항 및 제2항에 따른 환급 및 손해배상은 「콘텐츠이용자 보호 지침」에 따라 처리합니다.
4. 회사는 최근의 서비스 이용일부터 연속하여 1년 동안 회사의 서비스를 이용하지 않은 회원(이하 "휴면계정"이라 합니다)의 개인정보를 보호하기 위해 이용계약을 해지하고 회원의 개인정보 파기 등의 조치를 취할 수 있습니다. 이 경우 조치일 30일 전까지 계약해지, 개인정보 파기 등의 조치가 취해진다는 사실 및 파기될 개인정보 등을 회원에게 통지합니다.

제24조 (손해배상)
1. 회사 또는 회원은 본 약관을 위반하여 상대방에게 손해를 입힌 경우에는 그 손해를 배상할 책임이 있습니다. 다만, 고의 또는 과실이 없는 경우에는 그러하지 아니합니다. 특히 회원이 서비스를 이용함에 있어서 행한 불법행위나 본 약관 위반행위로 인하여 회사가 당해 회원 이외의 제3자로부터 손해배상 청구 또는 소송을 비롯한 각종 이의제기를 받는 경우 당해 회원은 자신의 책임과 비용으로 회사를 면책시켜야 하며, 회사가 면책되지 못한 경우 당해 회원은 그로 인하여 회사에 발생한 모든 손해를 배상할 책임이 있습니다.
2. 회사가 개별서비스 제공자와 제휴 계약을 맺고 회원에게 개별서비스를 제공하는 경우에 회원이 이 개별서비스 이용약관에 동의를 한 뒤 개별서비스 제공자의 고의 또는 과실로 인해 회원에게 손해가 발생한 경우에 그 손해에 대해서는 개별서비스 제공자가 책임을 집니다.

제25조 (회사의 면책)
1. 회사는 천재지변 또는 이에 준하는 불가항력으로 인하여 서비스를 제공할 수 없는 경우에는 서비스 제공에 관하여 책임을 지지 않습니다.
2. 회사는 서비스용 설비의 보수, 교체, 정기점검, 공사 등 기타 이에 준하는 사유로 발생한 손해에 대하여 책임을 지지 않습니다. 다만, 회사의 고의 또는 과실에 의한 경우에는 그러하지 아니합니다.
3. 회사는 회원의 고의 또는 과실로 인한 서비스 이용의 장애에 대하여는 책임을 지지 않습니다. 다만, 회원에게 부득이하거나 정당한 사유가 있는 경우에는 그러하지 아니합니다.
4. 회원이 서비스와 관련하여 게재한 정보나 자료 등의 신뢰성, 정확성 등에 대하여 회사는 고의 또는 중대한 과실이 없는 한 책임을 지지 않습니다.
5. 회사는 회원이 다른 회원 또는 타인과 서비스를 매개로 발생한 거래나 분쟁에 대해 개입할 의무가 없으며, 이로 인한 손해에 대한 책임을 지지 않습니다.
6. 회사는 무료로 제공되는 서비스 이용과 관련하여 회원에게 발생한 손해에 대해서는 책임을 지지 않습니다. 그러나 회사의 고의 또는 중과실에 의한 경우에는 그러하지 아니합니다.
7. 회사는 회원이 서비스를 이용하여 기대하는 이익을 얻지 못하거나 상실한 것에 대하여 책임을 지지 않습니다.
8. 회사는 회원의 게임상 경험치, 등급, 아이템, 게임 머니 등의 손실에 대하여 책임을 지지 않습니다. 다만, 회사의 고의 또는 과실에 의한 경우에는 그러하지 아니합니다.
9. 회사는 회원의 디바이스 비밀번호, 오픈마켓 사업자가 제공하는 비밀번호 등을 관리하지 않아 발생하는 제3자 결제에 대한 책임을 지지 않습니다. 다만, 회사의 고의 또는 과실에 의한 경우에는 그러하지 아니합니다.
10. 회원이 디바이스의 변경, 디바이스의 번호 변경, 운영체제(OS) 버전의 변경, 해외 로밍, 통신사 변경 등으로 인해 콘텐츠 전부나 일부의 기능을 이용할 수 없는 경우 회사는 이에 대한 책임을 지지 않습니다. 다만, 회사의 고의 또는 과실에 의한 경우에는 그러하지 아니합니다.
11. 회원이 회사가 제공하는 콘텐츠나 계정정보를 삭제한 경우 회사는 이에 대한 책임을 지지 않습니다. 다만, 회사의 고의 또는 과실에 의한 경우에는 그러하지 아니합니다.
12. 회사는 임시회원이 서비스 이용으로 발생한 손해에 대해서는 책임을 지지 않습니다. 다만, 회사의 고의 또는 과실에 의한 경우에는 그러하지 아니합니다.

제26조 (회원에 대한 통지)
1. 회사가 회원에게 통지하는 경우 회원의 전자우편주소, 전자메모, 게임 서비스 내 쪽지, 문자메시지(LMS/SMS) 등으로 할 수 있습니다.
2. 회사는 회원 전체에게 통지하는 경우 7일 이상 게임 서비스 내에 게시하거나 팝업화면 등을 제시함으로써 제1항의 통지에 갈음할 수 있습니다.

제27조 (재판권 및 준거법)
1. 서비스 이용과 관련하여 회사와 이용자간에 발생한 분쟁에 대하여는 양 당사자 간의 합의에 의해 원만히 해결하여야 합니다.
2. 만약 제1항의 분쟁이 원만히 해결되지 않는 경우 각 당사자는 콘텐츠 산업 진흥법에 따라 콘텐츠분쟁조정위원회에 분쟁조정을 신청할 수 있으며, 소송 절차를 통하는 경우 관련 법령에 정한 절차에 따른 법원을 관할 법원으로 합니다. 단, 제도 당시 회원의 주소나 거소가 대한민국 이외의 지역에 있는 경우는 서울중앙지방법원을 전속적 관할법원으로 정합니다.
3. 회사와 이용자간에 제기된 소송에는 대한민국 법을 준거법으로 적용합니다.
4. 본 약관의 내용 중 법적인 판단에 따라 무효 및 집행 불가의 항목이 있을 경우 해당 내용만을 무효로 간주합니다. 그 외의 약관 내용은 여전히 유효합니다.

제28조 (회원의 고충 처리 및 분쟁 해결)
1. 회사는 회원의 편의를 고려하여 회원의 의견이나 불만을 제시하는 방법을 게임 서비스 내 또는 그 연결화면에 안내합니다. 회사는 이러한 회원의 의견이나 불만을 처리하기 위한 전담인력을 운영합니다.
2. 회사는 회원으로부터 제기되는 의견이나 불만이 정당하다고 객관적으로 인정될 경우에는 합리적인 기간 내에 이를 신속하게 처리합니다. 다만, 처리에 장기간이 소요되는 경우에는 회원에게 장기간이 소요되는 사유와 처리 일정을 게임 서비스 내 공지하거나 제27조 제1항에 따라 통지합니다.
3. 회사와 회원 간에 분쟁이 발생하여 제3의 분쟁 조정기관이 조정할 경우 회사는 이용 제한 등 회원에게 조치한 사항을 성실히 증명하고, 조정기관의 조정에 따를 수 있습니다.

제29조 (약관 외 준칙)
이 약관에서 정하지 아니한 사항과 이 약관의 해석에 관하여는 「전자상거래 등에서의 소비자보호에 관한 법률」,「약관의 규제에 관한 법률」,「게임산업진흥에 관한 법률」,「정보통신망 이용촉진 및 정보보호 등에 관한 법률」,「콘텐츠 산업진흥법」 등 관련 법령 또는 상 관례에 따릅니다.
